What Happened?

In a recent development that endorses judicial support for home buyers’ rights, the High Court of Karnataka has permitted an allottee to withdraw ₹10,00,000 deposited by a developer during an ongoing litigation wherein the execution proceedings w.r.t. an order passed by the Adjudicating Officer, Karnataka, Real Estate Regulatory Authority were stayed pursuant to a Writ Petition filed by the Developer.

The Story:

A Bangalore-based developer approached the High Court challenging execution proceedings initiated by the Real Estate Regulatory Authority (RERA), Karnataka. The developer claimed that the revenue recovery certificate contained calculation errors of the interest for delay period granted by RERA and sought for a stay on execution. To secure an interim stay order, the developer deposited ₹10 lakhs with the court.

The allottee (home buyer) who was the respondent in this writ petition then filed an application requesting permission to withdraw this deposited amount. The High Court, in its order dated 21st January 2026, allowed the allottee’s application.

The real estate regulation and Development act 2016

The RERA Act was enacted with an aim to regulate and promote the real estate sector so that there could be transparency and efficiency in the conduct of the sale of an apartment, land, or a building. The RERA Act, through proper regulation, ensures protection to the interest and the rights of the consumers. The Act was enforced from 1st May 2017, across India after it was enacted by the Parliament in the year 2016.

 

With its implementation, RERA would bring a high sigh of relief for the homebuyers. The builders would be accountable for the promises that they make to the buyers. It would ensure that consumers are protected from fraud. Proper regulation would encourage consumers to invest without fear.”
